GARN-ST GERMAIN DEPOSITORY INSTITUTIONS ACT OF 1982

This is the Act that too many people wrongly claim protects Buyers from the Due-On-Sale clause if they put the title of the property in a Trust.   The relevant section is 341(c)(2)(d) that starts on Page 38.  Clearly if the Borrower is not a beneficiary or does not live in the property - the lender MAY call the loan due.
